Terms and Conditions
Please read these Terms and Conditions carefully before using Focusami. By creating an account, accessing the platform, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use Focusami. These Terms form a legally binding agreement between you and the person or entity that owns and operates Focusami ("we," "us," or "our"). Focusami is developed and operated by an independent developer based in India, and these Terms are governed accordingly.

1. Who We Are
Focusami is a productivity and focus application designed to help students, professionals, and creatives build deep work habits. The platform is developed and maintained by an independent developer operating out of India. The Service is accessible via the website at focusami.com, through the desktop application, and any other distribution channels we make available. 2. Eligibility and Account Registration
You must be at least 13 years of age to create an account and use Focusami. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed these Terms and consented to your use of the Service. We do not knowingly collect personal information from children under 13, and we will terminate any such account and delete associated data without notice. For users in the European Economic Area or the United Kingdom, the minimum age may be higher under applicable local law (for example, users in Germany must be at least 16 to consent independently to data processing under the GDPR). When registering, you agree to provide accurate, current, and complete information, to keep that information accurate, and to keep your login credentials confidential. You must not share your account, and we are not liable for loss arising from unauthorized access caused by your failure to safeguard your credentials. Each person may maintain only one account; creating multiple accounts to circumvent suspensions, bans, or feature restrictions is prohibited and may result in permanent removal.
3. The Service
Focusami provides tools to improve focus and productivity, including a Pomodoro-style Focus Timer with custom configurations, a To-Do List for setting micro-goals, public and private Study Groups for real-time co-working, Social Features such as friends and in-group chat, Focus Analytics and Metrics, Ambient Sounds, customizable Themes, and an optional Premium Subscription. We make reasonable efforts to keep Focusami available but do not guarantee uninterrupted access; the Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control, and we are not liable for loss arising from downtime. We may modify, add, or remove features at any time. We will make reasonable efforts to notify users of significant changes but reserve the right to alter the Service without prior notice, and continued use after changes constitutes acceptance of them.
4. User Conduct and Community Standards
By using Focusami, you agree not to: post or transmit content that is abusive, harassing, threatening, defamatory, hateful, discriminatory, or sexually explicit; impersonate any person or entity, including Focusami staff; spam other users or use chat or group features for commercial promotion without our written consent; disrupt or interfere with others' use of the Service; distribute malware, phishing links, or other harmful content; attempt to gain unauthorized access to any part of the platform, another user's account, or our servers and databases; use automated bots or scrapers to access or extract data; or engage in any activity that violates applicable law. We reserve the right to remove content, suspend accounts, or permanently ban users who violate these standards, with or without prior warning, and to report serious violations to law enforcement where required. If you create a group, you agree to moderate it reasonably and ensure it does not become a space for prohibited conduct; we may remove or archive groups that violate these Terms.
5. User-Generated Content
"User Content" refers to anything you post, share, or transmit through Focusami, including messages, group names, display names, profile information, and other material you submit. You retain ownership of your User Content. By submitting it, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, display, and reproduce that content to the extent necessary to operate and improve the Service; this license ends when you delete the content or close your account, except where copies have been shared with others and removal is not technically feasible. You represent that your User Content does not violate any third-party rights and complies with all applicable laws, and you are solely responsible for it. We do not endorse or verify User Content and accept no liability for it. We may remove any User Content we determine, in our sole discretion, violates these Terms or is otherwise inappropriate, and we are not obligated to store your content indefinitely.
6. Intellectual Property
All content owned or created by Focusami — including the application code, design, graphics, logos, interface elements, ambient sounds provided by us, text, and the "Focusami" name and mark — is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our proprietary content without our express written permission. If you submit suggestions, ideas, bug reports, or other feedback, you agree that we may use it freely without any obligation to compensate you or keep it confidential. Certain ambient sounds, fonts, or other assets may be sourced from third parties under appropriate licenses, and rights to such content remain with their respective owners.
7. Premium Subscription and In-App Purchases
Focusami offers a paid Premium subscription providing ad-free usage, ambient sounds, the ability to create public groups, and premium themes; current pricing and features are described on the website and may change over time. Premium is billed monthly or annually depending on the plan, and unless you cancel before the end of the current billing period, it automatically renews and you will be charged for the next period. Payments are processed by third-party providers, and by subscribing you authorize us or our processor to charge your payment method; we do not store your full payment card details. Given the nature of digital services, we generally do not offer refunds once a billing period has begun, but you may contact support@focusami.com about erroneous charges or significant technical issues and we will review case by case. For users in India, refunds may be governed by the Consumer Protection Act, 2019. For users in the EU and UK, you may have a statutory right of withdrawal within 14 days of your initial subscription purchase (you will lose Premium access immediately upon confirmation, and this right does not apply to renewals). The free tier includes advertisements shown when you are not actively in a focus session, and by using the free plan you consent to seeing them; Premium subscribers are not shown advertisements. We may change pricing at any time and will give existing subscribers reasonable advance notice, with continued subscription constituting acceptance of the new pricing.
8. Privacy and Data
Our Privacy Policy, incorporated into these Terms by reference, explains how we collect, use, store, and protect your personal information, and by using Focusami you also agree to it. As an Indian developer, we process data in compliance with applicable Indian law, including the Information Technology Act, 2000, the related 2011 Rules on sensitive personal data, and, upon implementation, the Digital Personal Data Protection Act, 2023, and we will notify affected users of a data breach as required by law. If you are located in the EEA, UK, or Switzerland, the GDPR or equivalent laws may apply, giving you rights including access, correction, deletion, and portability, exercisable by contacting support@focusami.com; we rely on legitimate interests and, where necessary, your consent as the legal basis for processing, and you may withdraw consent at any time. We do not knowingly collect personal information from children under 13, and the Service is not directed at them in the United States. If you are a California resident, the CCPA may grant you rights to know, delete, and opt out of the sale of personal information; we do not sell personal information. We retain account data while your account is active or as needed to provide the Service, and analytics and focus session data may be retained in aggregated, anonymized form after account deletion.
9. Third-Party Services and Links
Focusami may integrate with or link to third-party services, platforms, or websites for your convenience. We do not control them and are not responsible for their content, privacy practices, or terms. Your use of any third-party service is governed by that service's own terms and policies.
10. Disclaimers and Limitation of Liability
Focusami is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses, and we make no guarantee of any particular academic, professional, or personal result. To the maximum extent permitted by law, Focusami and its developer will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid us in the 12 months preceding the claim, or INR 1,000 (approximately USD 12), whichever is greater. Where jurisdictions do not allow certain limitations, they will apply to the maximum extent permitted by law. You agree to indemnify and hold harmless Focusami and its developer from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, your violation of these Terms, or your violation of the rights of another.
11. Termination
You may delete your account at any time through account settings or by contacting support@focusami.com; deletion results in the loss of your data, streak history, focus session records, group memberships, and other associated information, and Premium subscriptions are not automatically refunded upon deletion. We may suspend or terminate your access at any time, with or without cause or notice, including for violations of these Terms, and if your account is terminated for a violation you may not create a new account. Upon termination, all licenses granted to you under these Terms immediately cease, and provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
12. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles, and applicable Indian statutes including the Information Technology Act, 2000, and the Consumer Protection Act, 2019, apply to the extent relevant. Any disputes that cannot be resolved informally are subject to the exclusive jurisdiction of the courts located in India, and you agree to submit to the personal jurisdiction of such courts. Before initiating any formal legal proceeding, you agree to contact support@focusami.com and give us a reasonable opportunity (at least 30 days) to resolve the dispute informally. To the extent permitted by law, you agree to resolve disputes with us individually and not as part of a class action or class-wide arbitration.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this document and, for material changes, make reasonable efforts to notify you via email or an in-app notification. Your continued use of Focusami after the effective date of the updated Terms constitutes acceptance of them. If you do not agree with the updated Terms, you must stop using the Service and may delete your account.
14. Miscellaneous
These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and Focusami and supersede all prior agreements and communications on the subject. If any provision is found unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable or, if that is not possible, severed, with the remaining provisions continuing in full force. Our failure to enforce any right or provision is not a waiver of it. You may not assign or transfer your rights or obligations under these Terms without our prior written consent, while we may assign ours without restriction. These Terms are written in English, and in the event of any conflict between the English version and a translation, the English version prevails.
